Terms of Service

1. General Provisions

These Terms of Use (hereinafter – the “Terms”, the “Agreement”) constitute a legally binding agreement between Sabai Travel Co., Ltd. (hereinafter – “Sabai.travel”, the “Company”), registered in the Kingdom of Thailand, and any individual using the Sabai.travel website, mobile application, or any related services (hereinafter – the “User”). By using the Service, the User confirms their full and unconditional acceptance of the Terms.

2. Definitions

• Service — a technological platform 
• Sabai.travel, designed for searching, comparing, booking, and purchasing third-party services.
• Event — an excursion, tour, transfer, equipment/vehicle rental, workshop, show, or any other service provided by an Organizer.
• Organizer / Provider — a legal entity or individual offering Events through the Service.
• User — any person using the Service. 
• Order — a User’s request to book or purchase an Event. 
• Ticket / Voucher — a document confirming the right to participate in an Event.
• Profile — the User’s account.
• Payment Operator — a third-party organization responsible for processing payments.
• Privacy Policy — a document regulating the processing of personal data in accordance with the PDPA (Thailand). 

3. Role of Sabai.travel

3.1. Sabai.travel acts as an aggregator and provides a technological platform for posting information and processing bookings.

3.2. Sabai.travel is not: a tour organizer, carrier, lessor, travel agent, or tour operator; a party to the agreement between the User and the Organizer; responsible for the execution, quality, safety, or compliance of Events.

3.3. All obligations regarding the actual provision of services are borne by the Organizers/Providers.

4. Use of the Service

4.1. The User agrees to: use the Service only in a lawful manner; not interfere with the operation of the Service; provide accurate information; comply with local laws, including immigration, transport, insurance, and other regulations.

4.2. Sabai.travel is entitled to: modify the functionality of the Service; block or delete Profiles that violate the Terms; cancel or adjust incorrect prices mistakenly received from Organizers.

5. Booking and Payment

5.1. By placing an Order, the User confirms that they: have reviewed the Event description; agree with the Organizer’s terms; provide valid contact information.

5.2. Payments are processed by third-party payment operators; Sabai.travel does not store card data.

5.3. Sabai.travel may charge a service fee (if applicable), which is non-refundable.

6. Changes, Cancellations, and Refunds

6.1. Cancellation terms are determined by the Organizer and indicated on the Event page.

6.2. Sabai.travel does not make refund decisions and does not reimburse expenses in cases of: event cancellation by the Organizer; weather conditions; technical failures; transportation delays; force majeure.

6.3. No-show is considered full use of the service and is non-refundable.

7. Limitation of Liability

7.1. The Service is provided “as is”.

7.2. Sabai.travel is not liable for: actions of Organizers; injuries, accidents, loss of property; mismatch between the Event and User expectations; visa, medical, insurance, or transportation requirements; communication failures, API errors, system malfunctions; any indirect losses.

7.3. The maximum liability of Sabai.travel is limited to the amount of the service fee (if applicable).

8. Risks and Health Requirements

8.1. The User acknowledges the risks associated with: water activities; jet-ski, ATV, motorcycle, and boat rentals; diving, snorkeling, fishing; hiking, wildlife; participation in high-risk activities.

8.2. The User confirms that they: possess the necessary physical and medical ability; bear personal responsibility for their health and safety; hold required licenses (e.g., driver’s license).

9. Intellectual Property 

9.1. All materials of the Service belong to Sabai.travel.

9.2. The User is prohibited from copying, modifying, or distributing the materials. 9.3. By posting content (reviews, photos), the User grants Sabai.travel a non-exclusive license to use it.

10. Personal Data

Personal data is processed in accordance with PDPA Thailand and the Privacy Policy.

11. Changes to the Terms

The Company may modify the Terms at any time. Continued use of the Service constitutes acceptance of the updated version. 

12. Governing Law and Dispute Resolution

12.1. These Terms are governed by the laws of the Kingdom of Thailand.

12.2. Disputes are subject to resolution by competent courts of Thailand.
